Experience

Brian J. Chabarek represents public entities in matters involving civil rights violations, police liability, municipal liability, and public and private entities in employment law. He also has extensive litigation experience in the areas of automobile negligence, premises liability and workers compensation. He has represented municipalities and employers, as well as individual officers, directors and elected officials in matters involving the New Jersey Law Against Discrimination, Americans with Disabilities Act, Whistle Blower Claims, Title VII of the Civil Rights Act, both the Federal and State Family Leave Acts, various civil rights violations and other forms of discrimination and harassment matters.

Brian also provides consultation to assist clients in drafting and/or modification of Human Resource Policy handbooks as well as severance agreements, and restrictive covenants. He has represented clients in the state and federal courts and before the New Jersey Division of Civil Rights. He litigates claims made against municipal departments for Constitutional violations, including alleged excessive use of force, false arrest, inadequate police protection and has handled claims alleging wrongful termination based on political affiliation, breach of contract and breach of the implied covenant of good faith and fair dealing and other forms of harassment and discrimination. He has given lectures and training sessions to clients on various employment related issues, including the New Jersey Family Medical Leave Act. 

In 2008, Brian made New Jersey Law Journal's "40 Under 40" list of promising young attorneys.  He was also named Rising Star by New Jersey Super Lawyers magazine in each year from 2006 to 2010.
