Chad Moore and Juliann Alicino Successful in Appellate Division

On March 25, 2015, the Appellate Division upheld the trial court’s decision in James v. Ruiz. Partner Chad Moore originally tried the underlying case before Judge Savio in the Superior Court of Atlantic County. In that case the jury unanimously agreed that the plaintiff failed to prove a permanent injury. Plaintiff appealed the decision arguing that he should have been able to use the opinion of a non-testifying doctor in his summation. On Appeal, associate Juliann Alicino wrote the opposition brief for the Defendants and Chad Moore successfully argued the case. The opinion is expected to have substantial impact on the use of expert testimony at trial.  This decision has been approved for publication by the Appellate Division.
