What Employers Need to Know: New Jersey’s New Pay and Benefits Transparency Law

Effective June 1, 2025, New Jersey introduced a new era of transparency for job seekers and internal candidates. Under the New Jersey Pay and Benefits Transparency Law, workers seeking a new job, or employees within a company looking for a new role, now have the right to know the pay, benefits, and other forms of compensation that an employer is offering. This requirement applies to job postings in any format, including online platforms (websites, social media), print ads, company newsletters, and internal or external emails. Additionally, an employer must make reasonable efforts to notify current employees of promotional opportunities and new job openings. 

Employers subject to this law:

  • Employers who have 10 or more employees during 20 or more calendar weeks who conduct business, employ individuals, or accept applications within New Jersey
  • Job placement and employment agencies, including referral agencies
  • Public sector employers

Information employers must include in a job posting:

  • The hourly wage or salary of the position, or a range of the hourly wage or salary
  • A general description of the benefits offered (e.g. health insurance, PTO, retirement plans)
  • Any other compensation programs, such as bonuses, commissions, or incentive pay for which the employee would be eligible.

  • Attracts applicants who are better aligned with the role, seniority level, and capabilities
  • Enhances employer brand and reputation for fairness
  • Improves the candidate experience, reducing negotiation friction
  • Boosts employee morale and promotes a culture of trust
  • Streamlines efficiency in the hiring process

How this law holds employers accountable:

Employers who do not comply with the new law may be penalized for each job listing – regardless of how many platforms in which the listing appears. Penalties range from up to $300 for a first violation and up to $600 for subsequent violations.
