NEW JERSEY DRUNK DRIVING LAWS AND PENALTIES

The penalties for DWI / DUI offenses are in N.J.S.A. 39:4-50 and are summarized below:

First Offense with a Blood Alcohol Level Between .08% and .10%

 

  • Fines between $250 and $400
  • Jail 12-48 hours at the Intoxicated Driver Resource Center, plus imprisonment of not more than 30 days at the Court’s discretion
  • Loss of license for 3 months
  • Surcharge and other fines

 

First Offense with a Blood Alcohol Level Over .10% or Under the Influence of Drugs

 

  • Fines between $300 and $500
  • Jail 12-48 hours at the Intoxicated Driver Resource Center, plus imprisonment of not more than 30 days at the Court’s discretion
  • Loss of license for 7-12 months
  • Surcharge and other fines
  • Ignition Interlock Device at Court’s discretion. Mandatory if blood alcohol content is .15% or greater

 

Second Offense

  • Fines between $500 and $1000
  • 30 days community service
  • Jail 48 consecutive hours to 90 days
  • Loss of license for 2 years
  • Surcharge and other fines
  • Ignition Interlock Device 1-3 years following license restoration
  • Revocation of vehicle registration or the installation of Ignition Interlock Device during license suspension

Third Offense

  • Fine of $1000
  • Jail 180 days
  • Loss of license for 10 years
  • Surcharge and other fines
  • Ignition Interlock Device 1-3 years following license restoration
