Marc S. Gaffrey to Present at NJAIHA 2018 Professional Development Courses

Marc S. Gaffrey, Supervising Partner of the firm’s Environmental and Toxic Tort Litigation Department, will be presenting at the New Jersey American Industrial Hygiene Association’s (NJAIHA) 2018 Northeast Industrial Hygiene Conference Professional Development Courses held on Wednesday, December 5th.  

Marc will be instructing a course titled, “Are You Prepared to be an Expert Witness?” from 8:30 AM to 12:00 PM. The course will examine the complex aspects of translating the science and practice of industrial hygiene and other occupational health, safety and environmental disciplines from the workplace to the courtroom. Preparation of legal related court documents such as expert opinions, affidavits and depositions will be reviewed so that practicing industrial hygienists and other EHS professionals understand how their technical work may be used in legal proceedings. In addition, attendees will gain an understanding of how to prepare for and serve as an expert witness in these often complex cases. Additionally, there will be discussion of the distinction between where a professional serves as a consultant versus where he/she renders an expert opinion, and the particular privileges which exist limiting the professional’s disclosure of certain thoughts and impressions.

Attendees will break out into small groups to prepare to litigate a mock litigation scenario. This will be a facilitated exercise to enable participants to play the role of plaintiff, professional, employer and possibly other parties in a typical lawsuit of this nature.
