Jeffrey J. Czuba Obtains Dismissal on Directed Verdict

The matter arose out of a motor vehicle accident which occurred on 9/27/13 at the intersection of Hamilton St. and Matilda Ave. in Franklin, NJ.  The Plaintiff and Defendant (our client) both alleged that they had the green light when they entered the intersection.  Plaintiff alleged that she sustained multiple herniated discs in her cervical spine and lumbar spine for which she received several months of chiropractic treatment as well as pain management injections.  Following the close of plaintiff’s case in chief and upon our motion for involuntary dismissal the Court found that plaintiff had failed to prove a prima facie case of permanent injury caused by the accident in order to submit the matter to the jury.  Thus, our motion was granted.
