Ted Hubert to Present on Ethical Risk Management and Professional Liability at NJICLE’s 2025 Program

Ted Hubert will serve as the featured speaker at the upcoming Ethical Concerns in Risk Management 2025 seminar hosted by the New Jersey Institute for Continuing Legal Education (NJICLE) in cooperation with CNA Insurance.

In his presentation, Ted will address several of the most critical and often overlooked issues that expose attorneys and law firms to malpractice risk. Drawing on his experience counseling lawyers on ethics and professional responsibility, Ted will focus on strategies to prevent claims before they arise and strengthen compliance within modern legal practice.

Ted’s discussion will cover:

  • Implementing effective client intake procedures that reduce exposure from the outset
  • Avoiding the unintended creation of attorney-client relationships, a common source of malpractice claims
  • Ensuring clear and comprehensive engagement agreements
  • Identifying and responding to client red flags
  • The dangers of dabbling in unfamiliar practice areas, including competency concerns and “crossover” risks
  • The importance of timely reporting of actual and potential claims to a professional liability carrier
  • Learning from common errors and real claim examples
  • Managing malpractice exposure involving support staff and outside vendors
  • Understanding ethical duties under RPC 5.3 and RPC 1.4
  • Addressing AI-related risks, including confidentiality concerns and hallucinated outputs

Ted’s session will provide practical, real-world guidance for attorneys seeking to strengthen their risk-management practices and ensure ethical compliance in an evolving legal landscape.
