Frank Kontely Obtains Summary Judgment in Consumer Fraud Action

Frank Kontely obtained summary judgment in a consumer fraud action against multiple defendants including his clients, two local automobile dealerships.  In the Superior Court of New Jersey – Monmouth County, plaintiff had alleged that a prominent auto manufacturer conspired with several dealerships to offer a rare sports car for sale without an intention to sell.  Early in the case, at the pleadings stage, Frank filed a motion for summary judgment, which was granted.  Plaintiff then appealed the case, and the Appellate Division upheld the trial court’s decision.  Plaintiff appealed the New Jersey Supreme Court, but his petition for certification was denied.  Therefore, Frank’s clients were found not responsible for plaintiff’s alleged damages.
