Fiduciary Duties, Obligations and Liabilities

Actions of an executor, trustee, attorney in fact (power of attorney) and guardian are subject to claims of breach of their fiduciary duties.

A fiduciary may be removed for cause when, among other situations, he has embezzled, wasted, misapplied any part of the estate committed to his custody or abused the trust imposed upon him. He may also be removed if the fiduciary refuses to perform his duties.
