Ted Hubert, IV prevails in automobile liability trial in Middlesex County. Plaintiff claimed he sustained a disc herniation in his lower back resulting in three surgeries, including a lumbar fusion. Ted argued Plaintiff was at fault for causing the accident since he made a left turn while his client was proceeding straight through the intersection. Plaintiff presented an eyewitness to the accident who testified Ted’s client was speeding and blamed him for the accident. On cross-examination, Ted established the eyewitness’s speeding claim was not factually possible given her other testimony regarding the accident. Furthermore, plaintiff’s expert admitted that part of plaintiff’s need for surgery was due to a degenerative condition unrelated to the accident. After just over twenty minutes of deliberation, the jury returned a verdict finding Ted’s client was not negligent and awarded no damages.
