Rob Morello prevails in automobile liability trial in Atlantic County.  Plaintiff claimed two (2) new disc herniations in the neck and low back as well as aggravation of pre-existing neck and low back pain following a motor vehicle accident with Rob’s client on December 27, 2013.  Rob’s client admitted fault for the accident but denied that Plaintiff suffered any injuries. 

At trial, the Plaintiff was cross-examined with numerous prior medical records suggesting that he had severe neck and back pain for years prior to the accident with Rob’s client.  Further, Plaintiff’s treating pain management doctor admitted on cross-examination to not having considered the prior records before performing extensive pain management injections on the Plaintiff, undermining the doctor’s credibility. 

The six (6) person jury deliberated for approximately 30 minutes before returning a verdict in favor of the defendant, finding that Plaintiff failed to prove a permanent injury proximately caused by the accident.
