Thaddeus J. Hubert, IV Prevails in Automobile Liability Trial in Middlesex County before Judge Thomas Buck. Plaintiff claimed he suffered three disc herniations in his neck and one disc herniation in his low back which compressed a nerve in his spine requiring several epidural injections to help manage the plaintiff’s pain. At trial, plaintiff gave contradictory testimony regarding whether he still had any physical limitations and admitted he lied under oath at his deposition when he denied having a prior car accident just three months earlier. Furthermore, plaintiff’s expert, during cross-examination, admitted plaintiff’s claimed injury could have resulted from the prior accident. The jury found plaintiff did not suffer a permanent injury by objective credible medical evidence and did not award any compensation to plaintiff.
