The matter arose out of a motor vehicle accident that occurred in Atlantic City, New Jersey. Plaintiff alleged that he sustained permanent injuries to his cervical spine and lumbar spine. Plaintiff’s wife filed a loss of consortium claim in connection with Plaintiff’s claim. Prior to the accident giving rise to the present matter, plaintiff was involved in a prior accident with injuries to the cervical and lumbar spine. Plaintiff claimed he had no residuals following his prior accident and attributed his complaints and limitations to the most recent accident. The jury deliberated for only a short time and returned a unanimous verdict in favor of Defendant finding Plaintiff did not sustain a permanent injury. Neither plaintiff nor his wife were awarded damages.
