Ted Hubert IV prevails in Appellate Division

The plaintiff filed a lawsuit against Ted’s client claiming she negligently operated her motor vehicle causing an accident which resulted in plaintiff sustaining bilateral wrist fractures.  Following the accident, plaintiff could not perform basic tasks by herself, including using the bathroom, and underwent multiple unsuccessful surgeries to her right wrist.  Ted successfully dismissed the case on a motion for summary judgment. Plaintiff appealed and the Appellate Division affirmed the trial court’s decision.  The Appellate Division held Ted’s client correctly stopped prior to entering the intersection since the traffic lights were inoperable due to Hurricane Sandy.  Plaintiff, however, failed to stop and failed to recognize that Ted’s client had the right of way.  Thus, the Appellate Division affirmed the trial court’s dismissal of plaintiff’s case.
