Richard Gaeckle, Partner in the Firm, Receives a Successful Award on Behalf of a Solar Energy Provider

Richard Gaeckle, a Partner in the firm’s Construction Law and Green Building practice groups obtained a successful award on behalf of a solar energy provider, First Light Energy, before the American Arbitration Association. A former customer of First Light Energy had sued in Superior Court seeking damages which included the return of a deposit for the installation of a 32 kw solar energy system. The matter was dismissed in favor of an arbitration clause in the contract and proceeded under the jurisdiction of the American Arbitration Association Renewable Energy Section. First Light Energy responded and filed a counterclaim for breach of contract. After a binding hearing before the American Arbitration Association, the arbitrator denied the relief sought by the customer and awarded First Light Energy liquidated damages.
