Partner Robert S. Helwig Receives Another Win at Trial
02.24.2010On February 5, 2010, Robert S. Helwig, a lead partner in the general litigation department, completed a four day trial before the Honorable Alberto Rivas, at the Middlesex County Courthouse, on behalf of the defendant in a personal injury lawsuit, receiving a no cause verdict.
On February 5, 2010, Robert S. Helwig, a lead partner in the general litigation department, completed a four day trial before the Honorable Alberto Rivas, at the Middlesex County Courthouse, on behalf of the defendant in a personal injury lawsuit.
The Case arose out of an automobile accident that occurred on February 6, 2007. The defendant struck the rear of the plaintiff’s vehicle when the plaintiff came to a stop prior to executing a left hand turn.
The defendant stipulated to liability and tried the case on damages only.
Plaintiff was a 34 year old female with no prior history of accident or injury. Plaintiff alleged that she sustained injuries to her neck and back, including a large central cervical herniated disc and a lumbar herniated disc.
The defense expert, an orthopaedic surgeon, admitted that plaintiff had both the cervical and lumbar herniations; however, he testify that the discs were caused by degenerative disc disease and not related to the accident.
The jury agreed with the defense finding that plaintiff did not sustain a permanent injury and entered a verdict of no cause of action on behalf of the defendant.
