Partner Robert S. Helwig Receives Another Win at Trial

On February 5, 2010, Robert S. Helwig, a lead partner in the general litigation department, completed a four day trial before the Honorable Alberto Rivas, at the Middlesex County Courthouse, on behalf of the defendant in a personal injury lawsuit, receiving a no cause verdict.

The Case arose out of an automobile accident that occurred on February 6, 2007. The defendant struck the rear of the plaintiff’s vehicle when the plaintiff came to a stop prior to executing a left hand turn.

The defendant stipulated to liability and tried the case on damages only.

Plaintiff was a 34 year old female with no prior history of accident or injury. Plaintiff alleged that she sustained injuries to her neck and back, including a large central cervical herniated disc and a lumbar herniated disc.

The defense expert, an orthopaedic surgeon, admitted that plaintiff had both the cervical and lumbar herniations; however, he testify that the discs were caused by degenerative disc disease and not related to the accident.

The jury agreed with the defense finding that plaintiff did not sustain a permanent injury and entered a verdict of no cause of action on behalf of the defendant.
