Michael Kearns Successfully Argues for His Client in the Appellate Division

On January 13, 2012, the Superior Court of New Jersey, Appellate Division, decided in favor of the defendants in Perri v. Prestigious Homes, Inc.  Michael Kearns, a Partner in the firm, argued on behalf of his client Prestigious Homes, Inc., against a claim of consumer fraud by the Plaintiff who charged that the builders and realtors failed to disclose a flooding condition to him when he purchased his home and therefore sued under the Consumer Fraud Act.  The court affirmed the trial court decision in favor of the defendants as they found the record did not support the Plaintiff’s cause of action.  Dawn Marino, an associate with Michael, wrote the brief for the appeal.
