Appellate Court Upholds the Dismissal of the case NJDEP v. Dimant as Argued by Jacob Grouser of the Environmental and Toxic Tort Department

On March 18, the Appellate Division upheld the decision to dismiss our client, a dry cleaners, from NJDEP v. Dimant in a groundwater contamination case in Bound Brook, NJ, constituting a victory for our Environmental & Toxic Tort Department

On Friday, March 18, the Appellate Court affirmed the Somerset County Superior Court decision to dismiss our client, a dry cleaners in Bound Brook, NJ in NJDEP v. Dimant.  The court found that the NJDEP failed to prove that any discharge from the dry cleaners caused injury to the environment and required remediation. The appeal was argued by Jacob Grouser; brief was written by Marc Gaffrey and Cristyn Clifton.  The original trial was argued by Marc Gaffrey in January 2010.
