In the case Gemini Restoration v Chris Miseo, AIA a claim against an architect by a contractor alleged that the architect performed negligently in her role during construction approving the payment applications, Andrew J. Carlowicz, Jr. obtained a directed verdict at the close of plaintiff's case on behalf of the defendant/architect. Since the contractor inexplicably alleged that the architect had approved all of the invoices, and that despite this the owner failed to pay same, the court was convinced that there was no valid cause of action as a matter of law. A post-verdict motion against both the contractor, as well his his attorneys, under the New Jersey Frivolous Claims Statute has been filed and is pending.
