Jeffrey Czuba Receives a Favorable Verdict at Trial

Jeffrey Czuba, Partner in the firm, posts another trial victory

On May 6, 2011 partner in the firm, Jeffrey Czuba completed a four (4) day trial before Hon. Arthur Bergman, JSC at the Middlesex County Courthouse in Fiorello v. Instrumentation Technology Systems, Inc. (ITS),  This case arose out of an October 18, 2007 fall the plaintiff suffered at a municipal pump house. On that date a pump repair technician employed by ITS was called out to the pump house to diagnose and repair a problem with a flow meter. The plaintiff, a municipal foreman in the water department, unlocked and brought the technician into the pump house and then left to perform other duties. In order to perform the repair the technician had to remove a large and heavy grate in the floor to get to the sub-floor where the problem was. Plaintiff returned to the pump house after the work was completed and fell into the approximate 3ft. by 5 ft. hole in the floor injuring his left knee. 

As a result of the fall plaintiff alleged that he sustained a right leg fracture.  Despite the fact that plaintiff was back to work full time and on full duty, working over time, plaintiff's expert testified that plaintiff in the future would require total knee replacement surgery. After slightly more that an hour of deliberation the jury rendered a verdict finding plaintiff and defendant each 50% liable and awarding plaintiff a total of $1000.00. 

The verdict was molded to slightly less than $31,000 due to stipulated damages for unpaid medical bills and lost wages.
