Craig Corson, a Partner in the Employment Law Department is speaking at the Insurance Council of New Jersey Workers' Compensation and Commercial Liability seminar on March 18, 2011, at the Trenton Marriott. The presentation is entitled “Defending Employment Discrimination Claims Pursuant to Schmidt v. Smith.”
The Schmidt case was decided by the New Jersey Supreme Court in 1998, and has been subsequently interpreted and discussed in numerous decisions of both the Federal and State Courts. The decision compelled employers to defend and indemnify under their workers' compensation policies where its employees could demonstrate that they had suffered physical manifestations and/or illnesses from emotional injuries sustained within the working environment. Most cases interpreting this area of coverage occur in harassment, discrimination and wrongful termination cases.
